我们是从事中国人权活动及关心中国人权状况的人士,为段春霞女士即将被遣返中国吁请ICE暂缓执行。
段女士是中国江苏省著名人权人士倪金芳的妻子。因长期从事人权活动,倪先生一直经受中共迫害,曾被拘禁失去自由171天,释放后仍旧遭中共不断骚扰、迫害。长期以来,段女士竭力支持倪先生的抗议斗争,因此不断受到中共迫害。
2022年,倪金芳携女儿逃往美国,因此惹怒了中共,于是更加严厉地打击报复段女士。鉴于家庭分裂和自己经受的严重迫害,段女士于2024年9月28日通过走线来到美国,现在乔治亚州移民监狱。因为她有严重的视力疾患,生活极为困苦。鉴于中共一向残酷迫害逃离国境的公民,尤其是人权人士,如果把段女士遣返中国,她一定会遭到中共的无情迫害,且再也难以与身在美国的丈夫和女儿团聚,这无疑是一场严重的人道悲剧。
美国自立国开始是一个移民国家,全世界被迫害的人纷纷来到美国,以逃避其在母国经受的政治迫害,他/她們在此寻求庇护,努力建立新的生活,为使美国继续成为一個充满希望与自由的国土,做出贡献。同时,根据美国在1994年10月批准的联合国《禁止酷刑及其他残忍不人道或有辱人格之待遇或处罚公约》:“1. 如有充分理由相信任何人在另一国家将有遭受酷刑的危险,任何缔约国不得将该人驱逐、遣返或引渡至该国。2. 为了确定这种理由是否存在,有关当局应考虑到所有有关的因 素,包括在适当情况下,考虑到在有关国家境内是否存在一贯严重、公然、大规模侵犯人权的情况。“(第三条)。
中华人民共和国是当今世界上最大的迫害人权、制造人道灾难的国家,其对治下的人民、包括藏族维吾尔族汉族等所有个民族实施暴力统治和残酷压迫,如果将段女士递解回国,正是中共求之不得的,其遭遇至少将会像在2023年被老挝当局送囘中国的人权律师卢思位先生一样,受到任意拘禁、不公平的起诉和审讯,甚至入狱。这样的前车之鉴昭然存在,而且也是对中国民主人士的沉重打击。
因此,我们恳请美国ICE延缓递解段春霞女士回归中国(附件:个人简历)。

APlea to ICE to Suspend the Deportation of Ms. Duan Chunxia We are a group ofhuman rights defenders and activists who are concerned about the human rightssituation in China. We hereby appeal to the ICE to suspend the deportation ofMs. Duan Chunxia (段春霞) to China. Ms. Duan Chunxia is the wife of Ni Jinfang (倪金芳), a prominent rights defender in Jiangsu Province, China. NiJinfang has long been persecuted by the Communist Party of China (CPC) for hishuman rights activities. He was arbitrarily detained for 171 days while inChina and continued to be harassed and persecuted after his release. Ms. Duanhad always been supporting Ni’s work and was hence alsomade subject of persecution by the Chinese authorities.
In2022, Ni fled to the United States with their daughter. The CPC was angered andexerted even harsher retaliation against Ms. Duan.In light of the family splitand the severe persecution she endured, Ms. Duan came to the United Statesthrough a walk-in route on 28 September 2024. She is now in an immigrationprison in Georgia. Because of her serious visual impairment, her life has beenvery difficult. The CPC has a notorious record of brutally retaliating againstcitizens, especially the rights defenders, who seek to flee the country, we aregravely concerned of the plight of Ms. Duan if she is returned to China whereshe would highly likely be persecuted by the authorities and forbidden toreunite with her husband and daughter now seeking asylum in the United States.This will undoubtedly be a serious humanitarian tragedy.
Sinceits founding, the United States has been a nation of immigrants wherepersecuted people from around the world seek refuge, rebuild their lives andunceasingly contribute to make this a land of hope and freedom. United Statesratified the United Nations Convention against Torture and Other Cruel, Inhumanor Degrading Treatment or Punishment in October 1994. Article 3 of theConvention stipulates that 1. No State Party shall expel, return (“refouler”) or extradite a person to another State where there are substantialgrounds for believing that he would be in danger of being subjected to torture.2. For the purpose of determining whether there are such grounds, the competentauthorities shall take into account all relevant considerations including, whereapplicable, the existence in the State concerned of a consistent pattern ofgross, flagrant or mass violations of human rights.
ThePeople’sRepublic of China is the world’s largest perpetrator ofhuman rights violations, with notorious records suppressing peoples under itsregime, including the Han Chinese, Tibetans and Uyghurs. The CPC would bepleased to see rights defenders like Ms. Duan deported back to China, where shewould face the same fate as Mr. Lu Siwei, a human rights lawyer arrested inLaos and returned to China in 2023 to be arbitrarily detained, unfairlyprosecuted and convicted for imprisonment. This precedent not only represents asetback for those advocating for democracy in China but also calls for ourserious caution.
Inthis light, we urge the U.S. ICE to suspend the deportation of Ms. Duan Chunxiato China. (Annex on personal background as attached here below)

我是来自中国的人权活动人士倪金芳,2022我和女儿持旅游签证入境来到美国,目前正在寻求政 治庇护,日前,我的妻子段春霞收到美国移民局的遣返令,12月9日也就是6天后即将被遣返中国,根据旅行证文件,她将直接被送回中国沈阳。
我的妻子先前在中国多次遭到警察的迫害,包括威胁,恐吓,任意关押,强迫我妻子录视频发给我让我禁声。如果我的妻子被遣返,她将再次面临被迫害,甚至可能会被抓捕而入狱以及被中国 政府限制出境,而我和女儿因为不能回国恐怕此生再也见不到她。 这里我恳请您写信给美国ICE,暂缓遣返,以换取时间供我们的律师申诉。

我是苏州的公民,2012年12月3日,范木根反抗中共暴力强拆手刃歹徒,中国人权律师和苏州公民们相继介入救援范木根,我参与其中,这个事件成为2015年709大抓捕的导火索。

At Least Nine Rights Activists ‘Secretly Detained’ in China’s Suzhou

Annex:Emergency Assistance Request—Plea to Postpone the Deportation of Chunxia Duan I am JinFang Ni, a human rights defender from China.
In2022, my daughter and I entered the United States on tourist visas and arecurrently seeking political asylum. Recently, my wife, Chunxia Duan, received adeportation order from U.S. Immigration and Customs Enforcement (ICE). She isscheduled to be deported to China on December 9, just six days from now.
Accordingto her travel document, she will be sent directly to Shenyang, China. My wifehas been persecuted multiple times by the Chinese police, including beingthreatened, intimidated, arbitrarily detained, and forced to record videos topressure me into silence. If my wife is deported, she will face renewedpersecution, potential arrest, imprisonment, and restrictions on leaving China.Since my daughter and I cannot return to China, this could mean that we willnever see her again. I humbly request that you write to ICE to postpone herdeportation, allowing time for our attorney to appeal her case.
MyPersonal Background: I am a citizen of Suzhou, China. On December 3, 2012, anincident involving Fan Mugen, who resisted violent forced eviction by theChinese government and killed an assailant in self- defense, drew significantattention. Human rights lawyers and activists, including myself, supported FanMugen. This incident became a precursor to the 709 Crackdown in 2015.
InJuly 2015, the Chinese government launched the 709 Crackdown, arresting over300 human rights lawyers in an event that shocked the world. This event isreferred to as the “709 Crackdown.” Link to the U.S. StateDepartment statement on the 709 Crackdown.
Afterthe 709 Crackdown, I and other Suzhou-based human rights defenders publiclysupported the arrested lawyers. Our actions led to the Suzhou Crackdown onSeptember 8, 2016, during which the Chinese government arrested me and 11 otherdefenders. I was placed under residential surveillance for 171 days, chargedwith “pickingquarrels and provoking trouble,” and sentenced. I wasreleased on bail on April 28, 2017. Duringmy detention, my wife, Chunxia Duan, bravely campaigned for me and otherdetainees in the Suzhou Crackdown, raising funds and publicly advocating forus. In court, she even acted as my defense representative.
In2022, unable to endure the long-term harassment and persecution by the Chinesegovernment, I fled to the United States with my minor daughter. After arrivingin the United States, I publicly posted anti-Communist statements on Twitter.In response, Chinese police repeatedly threatened my wife, Chunxia Duan. BeforeXi Jinping attended the APEC summit in November 2023, she was coerced intorecording a video urging me to stop speaking out.
Underextreme pressure, my wife traveled through Mexico to the United States toreunite with me and our daughter. She now suffers from severe health problems,including significant vision impairment (retinal degeneration, macular disease,night blindness, and photophobia). Her vision health makes us super worried. OnDecember 2, I visited my wife at the immigration detention center in Georgia.Her fellow detainees informed me that she has difficulty walking and is noteating regularly. She urgently needs family care. Our minor daughter needs bothparental love and care from her mother. I earnestly request the U.S. governmentto grant us time so that our attorney can pursue legal procedures and allow ourfamily to reunite.
